GENERAL T’S & C’S

Cables Wake Park is available for you to access conditional on your acceptance without alteration of the Terms and Conditions set out in the Terms below.  You acknowledge that you have read, understood and agree to be bound by the Terms prior to purchasing your tickets.  If you do not agree you should not purchase tickets or enter the Park grounds.

Tickets can be purchased online through www.cableswakepark.com.au, at the entrance to the Park or via an authorised third party.  All tickets purchased through an authorised third party must abide by those individual Terms and Conditions upon purchase.

We may make changes to the Terms from time to time and, if the Terms affect your rights or obligations, we will endeavour to notify you in advance of the changes.  The most recent version of the Terms applies and, if you purchase Tickets or access the Park after a change to the Terms becomes effective, then you agree and acknowledge any revised Terms.

Cables Wake Park reserves the right to refuse entry or remove patrons for non-adherence to conditions of entry, failing to follow Staff or signage instruction, anti-social behaviour (including antisocial language), violence, theft, vandalism, intoxication, use or influence of illicit substances or inadequate supervision of people under your care.

Cables Wake Park fully supports the Smoke Free Environment Act 2000 and has adopted in principle this legislation making the Park a Smoke Free environment. Smoking is only permissible in the car park.  This includes vapes.

Vehicles are parked in the car park at your own risk. We will not be responsible for the loss of or damage to any vehicle, accessory or contents in or on any vehicle. 

CONDITIONS OF ENTRY

ALL participants must be able to swim competently without a flotation device.

No Pets, Skateboards, Scooters, Rollerblades, Bikes or Drones are to be brought into the Park at any time.   We have a bike rack out the front where belongings can be locked.  Bikes and Scooters are not to enter the Park at any time.

No personal speakers are to be used.  This is for the consideration of all guests.

No personal umbrellas/shade.  All our tables are undercover.           

No personal tables including folding tables, marquees or gazebos are permitted.

No foldable or pop up chairs.

You acknowledge that you have an obligation to yourself and others to act in a safe and responsible manner and follow the rules of Cables Wake Park and Aqua Park activities.

You acknowledge that there is open (unfenced) water at Cables Wake Park and you are not to enter ANY water without a life jacket.

You agree to follow all signage and rules imposed at Cables Wake Park.

Cables Wake Park is absolved from all liability (other than any negligence of Cables Wake Park), risks arising include, but are not limited to loss or damage to personal property, injury due to slipping, falling, collision, use of equipment injury or damage caused by group guests or other patrons.  You acknowledge that serious accidents can happen which may result in death or injury including but not limited to:

  • You may be physically or mentally injured, impaired, maimed or result in death.
  • Other participants may act dangerously or with lack of skill.
  • Conditions may be hazardous and may vary without warning or predictability.

You voluntarily agree, covenant and promise to accept and assume all responsibilities and risk for injury, death, illness or disease to yourself or to your property or other parties and their property arising from your attendance at Cables Wake (other than any negligence of Cables Wake Park).  Your participation and attendance is purely voluntary.

Cable and Aqua Park physical activities can be extremely strenuous for the body.  Customers with any pre-existing injuries or conditions or if pregnant are to refrain from these activities. Patrons who enter the park must advise Cables Wake Park Staff if they have any disability or health issues or conditions that may affect the activities of Cables Wake Park.  This must be advised when completing the waiver disclaimer form and upon arrival.

Casts are not permitted on any of the activities.

You grant permission for Cables Wake Park to video or photograph my activities while in the Cables Wake Park premises to be used for lawful media promotional purposes.

You acknowledge that Cables Wake Park does NOT issue refunds in the event of activities being suspended/cancelled due to wet or inclement weather.

Aqua socks are MANDATORY for everyone participating at Cables Aqua Park. Your safety is our main priority.

A waiver must be signed by all participants and a safety briefing watched/listened to (depending on activity).

MINOR SUPERVISION AND AGE RESTRICTIONS

Park Management will take all reasonable duty of care but will not accept responsibility for the supervision and wellbeing of minors.

If a guest / member is under the age of 18 years and will not follow the Park rules and directions from Staff they will not be allowed future entry without a Parent / Guardian.

Age restrictions apply for water activities – please see individual tickets prior to purchase.

FOOD

Outside food is permitted; however, commercially prepared food from external vendors (including, but not limited to, McDonald’s, KFC, Domino’s Pizza, etc.) is not permitted within the Park. Entry may be refused if such items are brought onsite.

The Park operates an onsite café offering a range of drinks, snacks, and meals for purchase.

Please note that we are unable to store personal food items, including cakes and platters, in our refrigerators or freezers. Guests are strongly encouraged to bring an Esky for temperature-sensitive items. Upon request, cakes may be stored in an air-conditioned room; however, the Park accepts no responsibility or liability for loss, theft, or damage to personal items.

Alcohol and glass items are strictly prohibited from being brought into the Park.

Food and beverage packages are available for pre-order in conjunction with bookings.

BBQ USAGE

Use of the Park’s BBQ facilities is available for a fee of $1–$2 (coin-operated), which provides approximately twenty (20) minutes of cooking time.

All BBQs are available for public use and are not reserved for private bookings. The BBQ unit closest to a booked area is not exclusive to that group, and all Park guests are entitled to access and use the facilities.

The use of personal BBQs or cooking equipment is strictly prohibited within the Park.

PRE-BOOKED TICKETS  

Booking Confirmation and Payment

Once a deposit has been paid, the booking is deemed confirmed and the guest agrees to be bound by the Booking Confirmation and these Terms and Conditions.

Booking details will be provided in a confirmation email issued via the booking system Roller. Guests are responsible for reviewing this confirmation carefully. Changes to bookings cannot be made on the day of the booking, and no refunds will be issued for incorrect purchases.

If only a deposit has been paid at the time of booking, the remaining balance must be paid in full no later than seven (7) days prior to the booking date. Payment must be received in clear funds.

If the minimum number of guests is not confirmed, or if final payment is not received by the required date (seven days prior to the booking), Cables Wake Park reserves the right to cancel the booking and reallocate the tickets or booked area to another guest.

Deposits are non-refundable, except as outlined in the Cancellation section below.

Arrival and Check-In

Guests must arrive at least forty-five (45) minutes prior to the scheduled booking start time to allow sufficient time for check-in, waiver verification, wristband allocation, and completion of the required safety briefing.

Guest Numbers and Booking Changes

Additional guests may be added to an existing booking with a minimum of forty-eight (48) hours’ notice, subject to availability. Additional tickets must be paid for at the time the booking is updated. Any special requests or specific booking details must also be finalised at this time.

All participants are required to complete and sign the online Waiver, acknowledging that they have read and agree to these Terms and Conditions. A parent or legal guardian must complete the waiver on behalf of any minor.

If guest numbers decrease on the day of the booking, refunds or credits will not be provided. Any unused tickets are forfeited, as they have been reserved and removed from sale to accommodate the booking.

Changes to bookings on the day of the booking are strictly not permitted.

“NO SHOWS”

For ticket holders who do not attend on the day of their scheduled booking, a gift voucher, re-schedule or refund will not be provided as we have catered for the booking with staffing and held the tickets from Sales.

Unfortunately, this includes not attending due to illness on the day.  With knowledge prior to the event, we will endeavour to accommodate (where possible) with a re-schedule or credit voucher.  This is at the discretion of Management.

We do not accept emails requesting a re-schedule, voucher or refund for change of mind due to personal circumstances.

CANCELLATIONS & REFUNDS

For tickets bought in-store or online, Cables Wake Park has a ‘no refund policy’ which is inclusive of inclement weather.  Cables Wake Park does not refund for incorrect purchases or change of mind.

The following terms apply with respect to cancelling or postponing the event: 

  • Over 15 working days written notice the deposit will be refunded in full. 
  • 6 – 14 working days written notice, the cancellation fee to be charged will be 50% of monies paid.
  • Within 5 working days written notice, the cancellation fee to be charged will be 100% of the final value of the event.   
  • “No shows” will forfeit ticket price. 
  • All gift cards have an expiry of 3 years from the date of purchase in accordance with Australian Consumer Law.
  • We will not re-schedule, refund or offer a voucher for change of mind due to weather & temperature if we are open and operational. 
  • We will not re-schedule, refund or offer a voucher if you do not check in within 45 minutes of your booking start time and miss part of your session due to in-house scheduling conflicts.
  • We do not accept emails requesting a re-schedule, voucher or refund for change of mind due to personal circumstances or illness outside of Monday – Friday office hours or after the booking time as we have catered to your booking and held those tickets for sale.

WEATHER

We operate in wet weather, and all bookings are catered for operationally. Requests for rescheduling, credit vouchers, or refunds due to a change of mind or undesirable weather preferences will not be accepted.

The Park operates daily throughout the season, rain or shine.  Operations may be suspended or the Park closed if weather conditions, including lightning or other extreme conditions, are deemed unsafe by Management.

If the Park closes for the day, guests remaining on-site at the time of closure will receive a complimentary return ticket valid for use during the current season. This ticket must be collected prior to leaving the Park. Vouchers will not be issued retrospectively via email, phone, or other channels.

Refunds are not provided under any circumstances.

If inclement weather passes within 60 minutes and operations resume, no weather vouchers will be issued to guests who choose to leave the Park prior to reopening.

PRICES

Prices quoted in AUD Dollars are inclusive of GST and negotiated at time of confirmation. Prices are subject to change without prior notice.

Prices vary from in-store to online.

Online sales cease 60 minutes prior to the session commencing.

Payments are non-refundable, except as specified in the “Cancellation” section.

MEMBERSHIPS

All memberships must only be used by the membership holder and are non-transferable.

If you are found to be sharing your membership band it will be cancelled without a refund.

DIRECT DEBIT MEMBERSHIPS

Direct Debit memberships are recurring weekly and ongoing until a membership is cancelled. 

A yearly membership does not cease after 12 months if it is a direct debit recurring weekly payment.

To cancel a membership please advise in writing to info@cableswakepark.com.au and allow 5 working days for this to be processed.

If an Annual Membership is cancelled prior to the contract expiry date, the member agrees to pay a cancellation fee of 50% on the remaining contracted balance, providing 30 days written notice to info@cableswakepark.com.au.

Failure to honour a membership to its expiry will result in you forfeiting the right for you to re-purchase any membership or ticket for the next 12 months.

Unfortunately, memberships are unable to be placed “on hold”.  Please contact us to discuss your options if you have been injured and can supply a medical certificate.

PRO SHOP

Gift vouchers – All gift cards have an expiry of 3 years from the date of purchase in accordance with Australian Consumer Law.

Try before you buy scheme – Demo a Wakeboard or Bindings from our demo range for $50 per demo. You will be issued a gift voucher to the amount of $50 per demo and this is to be put towards your next in-store purchase with a minimum purchase of $499.

Multiple vouchers can be used in one transaction with a minimum purchase of $499.

Vouchers will be sent to you via email.

SECURITY

Park Management reserves the right to exclude or eject any people from the Wake Park at any time if their behaviour is aggressive, offensive or inappropriate for a family environment.

Park Management reserves the right to stop any activities which in the opinion of Management is a nuisance, illegal, improper, indecent or unsafe.

All Park signage and instructions from Staff must be obeyed or you may be asked to leave.

ACCOMMODATION TERMS & CONDITIONS (below)

These terms and conditions may be updated from time to time and are subject to change at our complete discretion without further notice to you.

A sleeping bag is required for guests staying in our dormitory style bunk rooms.  Base sheets and pillows are provided.

RESERVATIONS

Reservations are subject to availability and actual pricing at the time of booking.  Any verbal quote given is an estimate only of price, which will be subject to written advice on confirmation of reservation. All accommodation bookings must be guaranteed at the time of reservation by payment of a deposit and Security Bond.

By payment of the Security Bond you authorise Cables Wake Park to charge the cost of $350 upon check-in to cover any additional charges or to cover any damages made by you.  This amount, if not used, will be refunded to you upon check-out.

CANCELLATIONS & REFUNDS

The following terms apply with respect to cancelling or postponing the event: 

  • Over 15 working days written notice the deposit will be refunded in full. 
  • 6 to 14 working days written notice, the cancellation fee to be charged will be 50% of the final (estimated) value of the event. 
  • Within five (5) working days written notice, the cancellation fee to be charged will be 100% of the final value of the event.   
  • “No shows” will forfeit full reservation costs. 

CHECK IN & CHECK OUT

Standard check-in time is 2.00pm.  The name of the reservation (or nominee) must be the person checking in.

Check-out time is 10.00am.

Please notify Staff in the event of arrival after 5pm.

Our Lodge facilities consist of a common room, which includes a self-contained kitchen with all crockery, cutlery, cooking utensils, microwave, hot plates, and fridge. The communal lounge area includes a wall mounted plasma television. The Lodge has a Washing Machine and dryer located in the men’s bathroom.  The lodge also has BBQ facilities available for accommodation guests.

Damage, breakages, theft, and losses are the tenants’ responsibility during their stay.

Additional cleaning fees may apply.

Cables Wake Park is NOT a licensed venue and alcohol is NOT allowed on the premises.

Glass bottles are not permitted.

The consumption of drugs or alcohol in rooms is strictly prohibited and may result in termination of booking, dismissal of guest without a refund and legal prosecution.

Smoking is NOT permitted at any time on site. An additional $350 cleaning fee will be charged.

For the enjoyment of all guests, noise restrictions apply after 10pm. Excessive noise is not tolerated.

The number of guests must not exceed the number stated on the booking confirmation notice or subsequently agreed in writing or email.

Lost or stolen keys will incur a $350.00 fee. Attempts will be made to contact the guest who will be given the opportunity to return keys taken. Failure to do so will result in the Bond being charged.

Room degradation (such as vomit, bodily wastes) will incur a $350.00 cleaning fee plus any professional floor cleaning charges at cost, plus a daily room tariff equal to the daily tariff that we would charge if the room was available to be let or any other rate that may be agreed to by the Management, in accordance with business demand on the day, until the said room has been returned to its saleable condition.

The breach of any of the above conditions may result in immediate termination of booking and incurred charges.

OTHER

Continental breakfast packs are available upon request. Please advise Staff when checking in if you require a breakfast pack if it is not already part of your booking.

Additional persons (including infants) will incur an additional charge

CHILD POLICY

Well behaved children of all ages are welcomed. As the Parents, Guardians or Chaperones of children you are personally and legally responsible for and must supervise them at all times. For safety reasons please do not leave children unattended in guest rooms or allow them to roam the Park unsupervised.

For the purpose of this clause “Child” or “Children” means a person or persons aged between 2 years and 17 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged 18 years or over. All ages will be determined from the date at which accommodation commenced. Children and infants may not stay in any room without an adult at any time.

UNACCOMPANIED MINORS

All guests under the age of 18 must be accompanied by a Parent /Guardian. The property has the right to refuse any booking when the legal guardian over 18 cannot provide current photo ID when requested on check-in.

PARTY POLICY

Zero tolerance party policy.

In the interest of quiet enjoyment and respect for all guests at the Park, a ‘no party’ policy applies to all guests staying at the property.

Guests are expected to be respectful of other guests at all times and to limit noise between 10pm – 7am.

COOKING & FIRE

Cooking in guest rooms is strictly forbidden by Health Authorities.

Fees for additional cleaning may apply should guest cook inside a guest room.

Due to Fire regulations, Management must be aware of number of guests in rooms. NO CANDLES OR OPEN FLAMES PERMITTED. Should the Fire Alarm be activated, the cost of Emergency Services attending will be charged to the guest.

PARKING AT OWN RISK

Parking for guests is free. All vehicles are parked at the risk of the owner. Cables Wake Park Penrith shall not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the Park’s property. If a vehicle is left on the Park’s parking lot after the guest has departed without the written consent of Management, the Park reserves the right to have the vehicle towed at the owner’s expense.

PETS

Apart from Sight and Hearing assistance dogs, ALL pets are strictly forbidden inside guest rooms. Any guests breaching this rule will face immediate eviction without refund and a $200 cleaning fee for carpet and any soft furnishing effected.

STATEMENT

Cables Wake Park has a strict policy for handling guest information. The information you provide to Cables Wake Park is confidential and protected to the fullest extent possible. Cables Wake Park will not disclose or distribute guest information to third parties without prior written consent by the guest or in the situation where we are required to by law.

However, by paying your deposit and Bond you agree to allow us to pass on to persons we deem appropriate your details should you or your visitors such as but not limited to:

  • Fail to settle your account;
  • Smoke in the room;
  • Room degradation (such as vomit, bodily wastes);
  • General damage to Park property, fittings, fixtures;
  • All non-standard cleaning charges;
  • And/or any problem sufficient to result in a room being withdrawn from its availability to let.

ACKNOWLEDGEMENT

By provision of these terms you accept full responsibility of any breakages, loss or damage to the Premises and/or its contents directly or indirectly caused by the Guest, or by any other occupant or any other person invited on or in the Premises by the Guest during the Tenancy and hereby authorise the Agent to pay for any such breakages loss, damage and all forms of cleaning (including but not limited to rubbish removal) of the Premises by deduction of the applicable amount from the Security Bond and where the Security Bond is not sufficient to cover the cost of payment required the Guest agrees to pay for the total cost of damages within 7 days of being notified in writing of the payment required by the Agent.

ENFORCEMENT OF TERMS & CONDITIONS

Upon paying your deposit and Bond you acknowledge that you have read and agree to and will abide by all the terms and conditions that are set out by Cables Wake Park Penrith.

The Guest acknowledges that they have read and fully understand the terms and conditions set out above and participates freely and accepts the risks involved.
